These Terms & Conditions apply to orders placed with Fast Fixings Direct Ltd trading as Fast Fixings Online (“Fast Fixings Online”, “we”, “us” or “our”).

Please read these Terms & Conditions carefully before placing an order.

Nothing in these Terms & Conditions affects any statutory rights that cannot lawfully be excluded or restricted.

2. Consumers and Business Customers

Some provisions of these Terms apply differently depending on whether you purchase from us as a consumer or for business purposes.

A Consumer is an individual acting wholly or mainly for purposes outside their trade, business, craft or profession.

A Business Customer is a person or organisation purchasing wholly or mainly for purposes relating to their trade, business, craft or profession.

Where a provision applies specifically to Consumers or Business Customers, this will be made clear.

3. Website & Product Information

We take reasonable care to ensure that product descriptions, specifications, prices, images and other information displayed on our website are accurate.

Product images are provided for illustrative purposes and may occasionally show other products, accessories or quantities that are not included with the item being purchased. Please refer to the product title, description, specification and quantity shown on the relevant product page and in your basket to confirm what is included.

Manufacturers may alter product specifications, packaging, appearance or design from time to time. Where such changes do not materially affect the nature or performance of the product, goods supplied may differ slightly from images shown.

Dimensions, capacities, performance information and other technical information supplied by manufacturers should be treated in accordance with any stated tolerances.

It is your responsibility to ensure that a product is suitable for your intended application. If you are unsure about suitability, please contact us before ordering. Nothing in this section affects a Consumer’s statutory rights where goods are faulty, misdescribed or otherwise do not conform to the contract.

4. Orders & Contract Formation

When you place an order through our website, you are making an offer to purchase the goods in your basket.

After placing your order, you will receive an automated acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.

A contract between you and us will be formed when we accept your order. Acceptance will normally take place when we confirm that the order has been processed for dispatch or when the goods are dispatched, whichever occurs first.

We reserve the right to decline an order before acceptance where, for example:

  • goods are unavailable;
  • we cannot obtain authorisation for payment;
  • we cannot deliver to the address supplied;
  • a product or price has been displayed incorrectly;
  • the order breaches an applicable legal or regulatory requirement; or
  • we reasonably suspect fraudulent or unauthorised activity.

If we cannot accept an order after payment has been taken, we will refund the amount paid for the affected goods.

Nothing in this section affects any rights you may have to cancel an order under applicable law.

5. Prices & Payment

Prices displayed on our website will indicate whether VAT is included or excluded, as applicable. The total price payable, including any applicable VAT and delivery charges, will be displayed during checkout before you place your order.

Payment must be made using one of the payment methods offered at checkout.

We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before accepting an order, we may contact you to offer the opportunity to purchase the product at the correct price or cancel the affected item.

If an obvious pricing error could reasonably have been recognised as an error, we reserve any rights available to us under applicable law.

Promotional codes, discounts and account pricing are subject to any conditions stated with the relevant promotion or account.

6. Availability

All products are subject to availability. Stock information displayed on our website is provided in good faith but may occasionally change before an order is processed.

If an item becomes unavailable after you have ordered it, we will contact you where appropriate and may offer an alternative, revised delivery timeframe or refund.

We will not substitute an item with a materially different product without your agreement.

7. Delivery

We aim to dispatch orders placed before 3pm Monday to Friday on the same working day, with delivery to most eligible UK mainland addresses typically taking 1–2 working days.

Some products have longer delivery lead times, including products advertised with an expected delivery timeframe of 3–4 working days. Where a specific delivery timeframe is displayed on a product page, that timeframe takes precedence over our standard delivery timeframe.

Delivery dates and timeframes are estimates unless we expressly state that a particular delivery date or service is guaranteed.

Orders may be dispatched from more than one location. Products within the same order may therefore arrive separately, at different times or using different courier services. Some goods may be dispatched directly from our suppliers using their respective courier partners.

Working days are Monday to Friday, excluding UK bank holidays. We do not normally dispatch orders on Saturdays, Sundays or bank holidays.

Additional delivery restrictions, charges or delivery times may apply to remote, offshore or other locations. These will be advised where applicable.

We will make reasonable efforts to deliver within the timeframe communicated to you. Nothing in these Terms limits any statutory rights a Consumer may have concerning delivery.

8. Delivery Addresses & Failed Delivery

You are responsible for providing a complete and accurate delivery address and appropriate contact information when placing your order.

Please contact us as soon as possible if you discover an error in your delivery details. We will make reasonable efforts to amend an address before dispatch, but we cannot guarantee that changes can be made once an order has entered processing or has been handed to a courier. An address change may result in a delay to delivery.

Additional carriage charges reasonably incurred as a result of an incorrect or incomplete address supplied by a Business Customer may be charged to that Business Customer. For Consumers, any additional charges will only be applied where permitted by law.

You are responsible for taking reasonable steps to enable delivery at the address supplied. If goods are returned following unsuccessful delivery attempts, we may contact you to arrange redelivery. A reasonable additional delivery charge may apply where permitted by law and where the failed delivery resulted from circumstances for which you were responsible.

9. Risk & Ownership

Consumers: Goods remain at our risk until they come into the physical possession of you or a person identified by you to receive them. Different rules may apply where you independently commission a carrier that was not offered by us.

Business Customers: Risk in the goods passes on delivery to the delivery address stated in the order or, where the Business Customer independently arranges collection or carriage, when the goods are transferred to the Business Customer or its appointed carrier, as applicable.

For Business Customers, ownership of goods will not pass until we have received payment in full for those goods. Until ownership passes, the Business Customer must, where reasonably practicable, keep unpaid goods identifiable and in satisfactory condition.

10. Returns, Cancellations & Faulty Goods

Our Delivery & Returns Policy forms part of these Terms and contains full information about cancellations, change-of-mind returns, faulty or incorrect goods, return costs and large, heavy or oversized products.

Consumers: Consumers purchasing online normally have a statutory right to cancel eligible purchases without giving a reason. A Consumer must normally notify us of cancellation within 14 days after the day the goods are received and, following cancellation, return the goods within a further 14 days.

For eligible Consumer change-of-mind returns, the Consumer is responsible for arranging and paying the direct cost of returning the goods where the required statutory information has been provided. Where applicable, we will refund the original standard delivery charge paid. Consumer statutory rights relating to faulty, damaged, incorrect, misdescribed or otherwise non-conforming goods are not affected.

Business Customers: Business Customers do not have the statutory Consumer cooling-off right and have no automatic right to return correctly supplied, non-faulty goods because they are no longer required, were ordered incorrectly, are surplus to requirements or because the Business Customer has otherwise changed its mind.

We may agree to accept a Business change-of-mind return at our discretion. Any such return must be authorised by us before the goods are returned. Where accepted, the goods must be unused, complete, undamaged and suitable for resale, and reasonable restocking, handling or other charges may apply where agreed as a condition of accepting the return. The Business Customer is responsible for return carriage unless we expressly agree otherwise.

Because goods may be dispatched from different locations, the correct return address may vary. Please contact us before returning any goods so that we can provide the appropriate return address and instructions.

11. Large, Heavy, Long & Oversized Goods

Certain products, including some ladders, long-length building materials and other large or heavy goods, cannot normally be returned using standard postal services.

For Consumer change-of-mind returns, the Consumer is responsible for the direct return cost where the required information has been provided before purchase. Where goods cannot normally be returned by post, we will provide the applicable return cost before the order is placed or, where that cost cannot reasonably be calculated in advance, an estimated maximum return cost.

Please contact us before arranging the return of large, heavy, long or oversized goods so that we can provide the correct return address and appropriate instructions.

This does not affect a Consumer’s statutory rights where goods are faulty, damaged, incorrect, misdescribed or otherwise do not conform to the contract.

12. Product Warranties

Some products are supplied with a manufacturer’s warranty or guarantee. Where applicable, details may be displayed on the product page or supplied with the product.

A manufacturer’s warranty is in addition to, and does not replace or restrict, a Consumer’s statutory rights.

Warranty coverage may not apply where damage or failure results from misuse, incorrect installation, modification, neglect, accident, abnormal use, overloading, failure to follow manufacturer instructions or normal wear and tear, subject always to applicable law.

13. Product Suitability, Installation & Use

Many products sold by Fast Fixings Online are technical construction, fixing, fastening, access, building or maintenance products.

Product information and guidance provided on our website is intended to assist with product selection but cannot account for every installation, substrate, load, environment or application.

Customers are responsible for selecting products appropriate to their intended use and for following applicable manufacturer instructions, technical documentation, building requirements and safety guidance.

Where specialist design, structural calculations, installation expertise or professional approval is required, appropriate competent advice should be obtained.

Nothing in this section excludes our responsibility where goods are faulty, misdescribed or not fit for a particular purpose made known to us in circumstances where the law provides a remedy.

14. Protective Coatings & Finishes

Some fasteners and fixings are supplied with protective coatings or finishes, including zinc plating and other corrosion-resistant treatments.

Performance and suitability can depend on the material, coating, installation method and environmental conditions. No coating or plating process can necessarily eliminate every risk associated with the material or manufacturing process, including hydrogen embrittlement where relevant.

Customers must follow applicable manufacturer specifications and guidance when selecting coated products for a particular environment or application.

Nothing in this section excludes or restricts liability or statutory rights where it would be unlawful to do so.

15. Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform an obligation where that delay or failure results from circumstances outside our reasonable control.

These may include severe weather, transport or courier disruption, industrial action, failure of telecommunications or payment systems, fire, flood, acts of government, civil emergencies or significant supply-chain disruption.

Where such an event affects an order, we will take reasonable steps to minimise the effect and will contact you where appropriate. For Consumers, this clause does not remove any statutory rights you may have where goods are not delivered within an agreed or legally required timeframe.

16. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

Consumers: We are responsible for losses that are a foreseeable result of our breach of the contract or our failure to use reasonable care and skill, subject to applicable law. Where goods are purchased wholly or mainly for personal purposes, we are not responsible under the Consumer contract for business losses arising from their use for commercial purposes, to the extent permitted by law.

Business Customers: Subject to the liabilities that cannot lawfully be excluded and to the extent permitted by law, we will not be liable for indirect or consequential loss or for loss of profit, revenue, business, contracts, anticipated savings or goodwill arising from the contract. Any exclusion or limitation of liability is subject to applicable law, including applicable statutory reasonableness requirements.

17. Intellectual Property, Third-Party Websites & Privacy

Unless otherwise stated, original content on the Fast Fixings Online website, including our text, graphics and branding, is owned by or licensed to Fast Fixings Direct Ltd. Manufacturer names, trademarks, images and other intellectual property remain the property of their respective owners.

Our website may contain links to third-party websites. We are not responsible for the content, availability or privacy practices of third-party websites that we do not operate.

We process personal information in accordance with our Privacy Policy and applicable data protection law. Please refer to our Privacy Policy for further information.

18. Changes to These Terms

We may update these Terms & Conditions from time to time. The Terms applicable to an order will normally be those in force when the order is placed, subject to any subsequent change required by law or expressly agreed between you and us.

19. General

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary and the remaining provisions will continue in effect.

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

Unless expressly stated otherwise, no person other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

20. Governing Law & Jurisdiction

Consumers: These Terms are governed by English law. If you are a Consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory legal protections applicable in the part of the UK in which you live. Nothing in these Terms is intended to deprive you of those protections. Any dispute may be brought before the courts having jurisdiction under applicable law.

Business Customers: These Terms and any dispute or claim arising out of or in connection with them or the contract shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction over disputes between us and Business Customers, except where applicable law requires otherwise.
